Philadelphia police have determined that a patron at a Frankford bar justifiably shot two other patrons, including one fatally, during an exchange of gunfire early Friday.

A quarrel broke out shortly after 1 a.m. at the Irish Kitchen, 1257 Pratt St., according to Officer Jillian Russell, a police spokeswoman. During the altercation, a 25-year-old man allegedly pulled out a handgun and shot a 29-year-old man in the right thigh. Police identified the gunman as Dallas Custalow, of the 1300 block of Anchor St.

The 29-year-old victim pulled out a gun, which he was licensed to carry, and returned fire, striking Custalow once in the abdomen. Custalow was pronounced dead at Temple University Hospital just before 1:30 a.m.

The 29-year-old was treated at Hahnemann University Hospital and released.

A third man was also wounded in the shootout. The 20-year-old was struck in the head and taken to Albert Einstein Medical Center, where he was listed in critical condition. His role in the dispute was not identified.

Police have not released the identities of two of the wounded men.

No criminal charges have been filed.
